Pre-nuptial Agreements & Co-habitation Agreements
Following the introduction of the Family Law (Scotland) Act 2006 certain rights are granted to couples who are living together but are not married or in a civil partnership. If this applies to you then you may wish to consider putting in place an Agreement to identify any issues that may affect your relationship, for example if one of you has contributed more to the purchase price of a property in which you live. These types of Agreements will be taken into account if you were ever to split. This is an issue which people find difficult to address and you certainly do not wish to take the bloom off a new relationship by suggesting that there could be a split, but it is better to be prepared in case such a situation does arise rather than go down the route of a messy split.
